Rape charges are found under Section 3121 of the crimes code. A person commits a rape when he engages in sexual intercourse with a person by force, threat of force that would prevent resistance by a person of reasonable resolution, with a person who is unconscious or unaware that sexual intercourse is occurring, with a person when the defendant has substantially impaired the person's power to control his or her conduct through drugs or intoxicants, or when the person is mentally disabled.
A person can be charged with rape of a child when a person has sex with a minor less than 13 years of age, and rape of a child with serious bodily injury if the facts support this charge.
RAPE PENALTIES
The crime of rape is a first-degree felony punishable by a maximum term of imprisonment of up to 20 years. Enhanced penalties may apply when the victim has been "drugged," or when the victim is a child.
