Tier 1 – Lowest Tier Pennsylvania DUI Offenses - Two Types of Charges #1 - Incapable of Safe Driving Without an Accident or Refusal (75 Pa.C.S. §3802(a)(1)) #2 - Adult with BAC of .08-.99% (75 Pa.C.S. § 3802(a)(2))

First-Offense Penalties
