Simple Assault Charges Dismissed in Greene County
In September of 2016, Simple Assault charges were dismissed against a Greene County military veteran and his wife, as the Commonwealth did not have sufficient evidence to proceed. In this case, the client and his wife were both charged with Simple Assault and Harassment, stemming from an incident where police observed physical markings on both individuals consistent with an assault.
At the preliminary hearing, both husband and wife exercised their Constitutional Rights to remain silent and to not testify against one-another. Both parties also signed affidavits indicating that they did not wish to prosecute against one-another. Thereafter, the Magisterial District Judge dismissed the charges against both individuals, allowing them to return home to continue with marital counseling.
