DECEMBER 2021

  • Carrying Firearm Without a License, DUI, 2x Accident Causing Damage to Attended Vehicle, Possession of Drug Paraphernalia (Allegheny): Client facing max sentence of up to 10.5 years in jail, 72-hour mandatory minimum jail sentence and permanent felony record if convicted. Result: At preliminary hearing, agreement reached where Firearm and Accident charges were withdrawn. Client facing DUI and Paraphernalia offenses at higher court.

  • Public Urination and Open Container (Allegheny): Client facing summary convictions that could not be expunged for minimum period of 5 years, fines and court costs exceeding $1,000. Result: Charges dismissed.

  • Registration Violation (Washington): Out of state CDL holder facing MVR record and points. Result: Attorney Milardo proceeded to summary trial where client was found not guilty due to lack of sufficient evidence.

Result: Citations reduced to 15mph and 10mph over, reducing points to 5 total, avoiding 30-day license suspension.

  • Underage Drinking (Allegheny): College student living out of state facing publicly searchable summary conviction that cannot be expunged until turning 21 years of age along with $500 fine plus costs.   • DUI and M3 Disorderly Conduct (Allegheny): Client facing 72-hour mandatory minimum jail sentence, max sentence of up to 18 months in jail and a 12 month license suspension. Result: Attorney Zuckerman proceeded to a preliminary hearing where the Magisterial District Judge dismissed the DUI and M3 DC charges, instead finding client guilty of lesser offense of summary disorderly conduct for fines/costs only.

  • 2 Cases for Driving on a Suspended License DUI Related (Allegheny): Client faced traffic warrants for failing to appear in court several years prior. At each case, client faced 60-day mandatory jail sentence, 2 year license suspension, and fines totaling $1,000 plus costs. Result: Attorney Zuckerman successfully had charges fully dismissed at one case and charge amended at the second case to a Registration violation.   • Careless Driving, Roadways Laned for Traffic and Lane Violations (Lawrence): CDL holder facing major traffic violations for the late offenses and 3 points. Result: Agreement reached for plea to careless driving only, avoiding major traffic violations on MVR. 3 points imposed.

  • Overweight Truck Violation (Allegheny): CDL holder from out of state facing MVR points if convicted. Result: Negotiated reduction to 6502B violation, which does not appear on MVR.

  • Driving on a Suspended License DUI Related (Armstrong): Client facing mandatory 60-day jail sentence and 12-month license suspension. Result: Attorney Milardo negotiated reduction to Driving Without a License, eliminating suspension and jail time.

  • M1 Retail Theft (Allegheny): Client facing max sentence of up to 5 years in jail and a permanent criminal record. Result: Negotiated agreement for client to complete retail theft educational course and pay restitution in return for a future withdrawal of charge. Outcome pending.

  • Careless Operation of Watercraft (Allegheny): Green card holder facing a non-traffic conviction that cannot be expunged for minimum period of 5 years, possible immigration consequences. Result: Negotiated agreement for client to complete community service in return for a withdrawal.

  • F3 Promoting Prostitution, Possession of Instrument of Crime and Conspiracy (Butler): Client facing max sentence of up to 20 years in jail and a permanent felony record. Result: Negotiated plea at magistrate level to M3 Disorderly Conduct for a fine only. Client released from jail that day.

  • Possession of Marijuana, Possession of Drug Paraphernalia and Driving on a Suspended License DUI Related (Allegheny): Client facing max sentence of up to 16 months in jail and mandatory minimum 60 day jail sentence. Result: Negotiated reduction to summary disorderly conduct and plea to suspended license charge for 60 days of house arrest.

  • Driving on a DUI Suspended License (Lawrence): Client facing mandatory 60-day jail sentence upon conviction. Result: Successfully argued based upon caselaw for imposition of no jail time.

OCTOBER 2021

  • 2 Cases - Delivery of a Controlled Substance, Possession With Intent to Deliver, Possession of a Controlled Substance; Aggravated Assault on a Police Officer, M3 Disorderly Conduct, Obstructing Law Enforcement (Allegheny): Client with extensive criminal record facing standard range sentence of 37-74 months of incarceration on most serious charges for each case. Maximum sentence faced of over 25 years. Result: Agreement negotiated for client to plead guilty to drug case and reduced offense of Simple Assault. Aggravated Assault on a police officer charges were withdrawn. No agreement on sentencing. Attorney Milardo successfully advocated on client’s behalf for a 5 year probationary sentence, and no jail time.

  • Required Financial Responsibility and Speeding 27mph over (Allegheny): Client facing mandatory 90-day license suspension and 5 points if convicted. Result: Charges dismissed.

  • Racing on Highways (Allegheny): Client represented himself at magistrate’s office and was convicted, leading to imposition of 6 month license suspension. Firm was hired for summary appeal representation. Result: Attorney Milardo negotiated reduction to alternative offense carrying no points or suspension.

SEPTEMBER 2021

  • Accident with Unattended Vehicle (Westmoreland): CDL holder received a 1 year CDL disqualification for conviction at magistrate level. Firm hired to file summary appeal. Result: Attorney Milardo negotiated reduction to Careless Driving offense. Resolution led to removal of CDL disqualification, but 3 points imposed on driving record.

  • 2x Stalking (M1) and 2x Harassment (M3) (Allegheny): Client facing max sentence of up to 12 years in jail and permanent criminal record. Result: Agreement negotiated limiting contact amongst parties. If client complies with agreement, charges will be reduced to summary harassment offense only. Outcome pending.

  • 3x Endangering Welfare of Child (2 counts as F3, 1 count as M1) (Allegheny): Client facing max sentence of up to 19 year in jail, permanent felony record if convicted. Result: Negotiated agreement for client to complete parenting classes in return for reduction to summary disorderly conduct. All felonies and misdemeanor charges withdrawn.

  • Defiant Trespass (M3) and Disorderly Conduct (M3) (Allegheny): Client facing max sentence of up to 2 years in jail and a permanent criminal record. Result: Negotiated reduction to summary disorderly conduct with no further penalty. Misdemeanor charges withdrawn.

  • DUI Highest Tier and Possession of Marijuana and Paraphernalia (Allegheny): Client facing mandatory minimum 72 hour jail sentence, 12-month license suspension and max sentence of up to 19 months in jail. Result: Drug charges withdrawn at preliminary hearing.
